Terms of Service
Effective 29 October 2026
These terms are an agreement between you and Mahanth Limited (“we”, “us”), a company registered in England and Wales, for your use of OrderSmart — the mobile app and the website at ordersmart.in (the “Service”). By creating an account or using the Service you agree to them. If you are using OrderSmart for a business, you confirm you are authorised to accept these terms on its behalf.
What OrderSmart is
OrderSmart lets a business record customer orders and memberships, track payments, issue GST invoices, and send transactional updates to its customers over WhatsApp. It is a tool for the business; the business remains responsible for what it sells, what it charges, and what it tells its customers.
Your account
- You sign in with a mobile number verified by a one-time code. Keep that number under your control; anyone who can receive codes on it can access your account.
- The person who creates a business is its owner. Owners may invite managers and staff, who can act for the business to the extent of the role given to them. You are responsible for what people you invite do in the Service.
- You must be at least 18 to use OrderSmart.
Your customers' information
Names, phone numbers, orders and payments you enter about your customers belong to you and are processed by us on your behalf. You are responsible for having the right to enter and use that information, and for telling your customers how you use it. Our Privacy Policy explains what we do with it.
Messages sent on your behalf
- When you take an action in the Service — confirm an order, mark it packed, send a payment reminder, welcome a member — OrderSmart may send the customer a message on WhatsApp through Meta's WhatsApp Business Platform, using the business name you gave us.
- Send messages only to people who have transacted with your business and expect to hear from you about it. Do not use OrderSmart for marketing broadcasts, unsolicited messages, or anything that breaches WhatsApp's Business and Commerce policies. We may suspend messaging for a business that does.
- Delivery depends on Meta and on the customer's phone and number. We show you the delivery status we receive, but we cannot guarantee that a message is delivered or read.
Plans, fees and billing
- The Free plan is free for up to 30 active members per business. Paid plans are priced per month on the number of active members, as shown on ordersmart.in/#pricing and inside the app. No plan limits the number of orders, and we never charge a commission on what you sell.
- Paid plans are billed monthly in advance through our payment provider and renew automatically until cancelled. You can cancel from inside the app; the plan stays active until the end of the period already paid for. Fees already paid are not refunded except where the law requires it.
- Prices include GST unless stated otherwise. We may change prices with at least 30 days' notice in the app or by message to the account's mobile number.
Payments between you and your customers
OrderSmart records payments; it does not hold or move your customers' money. Where a payment is made through a payment provider we integrate, that provider's terms apply to the transaction. Invoices generated by the Service are prepared from the information you enter; you are responsible for their accuracy and for your tax obligations.
Acceptable use
- Do not use the Service for anything unlawful, to sell goods or services that are illegal where you or your customer are, or to harass anyone.
- Do not try to access other businesses' data, probe or disrupt the Service, or copy it to build a competing product.
- Do not upload content you do not have the right to use.
Availability and changes
We work to keep OrderSmart available and reliable, but it is provided “as is” and we do not promise it will be uninterrupted or error-free. We may add, change or withdraw features; where a change materially reduces what you pay for, we will tell you in advance.
Ending the agreement
- You can stop using OrderSmart at any time. Owners can delete a business and all its data from Settings; account deletion is described in the Privacy Policy.
- We may suspend or close an account that breaches these terms or puts the Service, other users or their customers at risk. Where practical we will warn you first and give you a chance to put things right.
- After closure we delete your data as described in the Privacy Policy, keeping only what tax law requires us to retain.
Liability
Nothing in these terms limits liability that cannot be limited by law. Otherwise, we are not liable for loss of profit, revenue or business, or for indirect or consequential loss, and our total liability to you in any twelve-month period is limited to the fees you paid us in that period (or £100 if you are on the Free plan). We are not liable for failures caused by Meta, payment providers, mobile networks or other services outside our control.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting mandatory consumer protections in the country where you are based.
Changes to these terms
We may update these terms. For material changes we will update the effective date above and notify you in the app or by message at least 14 days before they take effect. Continuing to use OrderSmart after that date means you accept the updated terms.
